1. Introduction and Agreement
1.1 The Service: TailorShopNearMe.ae (“We,” “Us,” “Our,” or the “Company”) provides a range of bespoke tailoring, alteration, repair, custom manufacturing, and styling services to individual consumers and businesses in the United Arab Emirates (the “Services”).
1.2 Agreement to Terms: By accessing or using our website, placing an order (whether for alteration, custom work, or B2B manufacturing), and/or utilizing our pick-up/delivery service, you (“Client” or “You”) agree to be bound by these Terms and Conditions, as well as our Privacy Policy.
1.3 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE) and the Emirate of Dubai.
2. Ordering, Pricing, and Payment
2.1 Quotation and Pricing: All prices provided are quotations only and may be subject to adjustment upon a final in-person fitting or professional assessment of the garment/design complexity. * For standard alterations, a clear price list is available upon request or at the time of consultation. * For custom suits, dresses, or B2B manufacturing, the final price is confirmed in a separate written Order Confirmation or contract.
2.2 Payment Terms: * Alterations and Repairs: Full payment or a substantial deposit (as agreed) is generally required before work commences. * Custom/Bespoke Orders: A non-refundable deposit (typically 50-70% of the total price) is required to commence work, covering material sourcing and initial labor. The remaining balance is due upon final fitting and prior to collection or delivery.
2.3 Cancellations: * Alterations: You must notify us within 24 hours of placing the order to cancel or hold the service. Cancellations after this period may incur a cancellation fee to cover work already started. * Custom Orders: The initial non-refundable deposit covers design and material costs and will be forfeited upon cancellation.
3. Tailoring and Alteration Services
3.1 Workmanship Assurance: We guarantee the quality of our tailoring and alterations. * If you are unsatisfied with the fit of an alteration pinned and measured by our staff, we will re-alter it for free. * The garment must be returned for re-alteration within 10 days of the original collection/delivery date.
3.2 Client-Provided Instructions: We are not responsible for alterations or custom garments that do not fit or meet expectations if the instructions, pins, or measurements were provided by the Client (e.g., self-pinned, provided measurements). Additional charges will apply for any re-work required in these cases.
3.3 Garment Condition: All garments presented for alteration must be clean. We reserve the right to refuse service for any item deemed unsanitary.
3.4 Bespoke and Custom Manufacturing: For custom-made garments, we rely on the accuracy of the final fitting. While we strive for perfection, minor adjustments after the final fitting may be subject to a fee.
4. Liability and Garment Care
4.1 Limitation of Liability (Damage to Garments): We exercise the utmost care in handling all items. However, tailoring and alteration carry inherent risks. * Our maximum liability for any damage or loss of a garment due to our negligence is strictly limited to the lower of the following: * The fair market value of the garment (proof of purchase required). * Three (3) times the total cost of the service charged for that specific item. * We are not liable for damage caused by pre-existing conditions, fabric defects, color bleeding, or issues resulting from improper care instructions after the garment is collected.
4.2 Uncollected Garments: Garments that are not collected or for which final delivery cannot be arranged within sixty (60) days from the completion date will be considered abandoned. We reserve the right to discard or donate abandoned items to charity after making reasonable attempts to contact the Client via phone and email.
5. Custom Manufacturing and B2B Services
5.1 Intellectual Property (IP): If you provide us with a design, logo, or trademark for manufacturing (e.g., uniforms, private label), you warrant that you own the necessary IP rights or have the full authority to use them. You agree to indemnify TailorShopNearMe.ae against any claim of infringement related to materials you provide.
5.2 Minimum Orders (B2B): While we advertise “No Minimum Quantities” for certain services, volume pricing and turnaround times will be based on the quantities agreed upon in the separate B2B Service Agreement.
6. Privacy and Communication
6.1 Data Protection: We are committed to protecting your privacy in compliance with UAE Federal Law. We will not use your personal data (including contact details and measurements) for promotional purposes or share it with third parties without your explicit consent.
6.2 Communication: By providing your contact information, you consent to receive communication (SMS, email, WhatsApp, or phone call) regarding your order status, fitting appointments, and delivery.
